Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services, software, and digital products provided by Starbyte Studio LLC ("Company," "we," "us," or "our"). By creating an account or using any of our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our services, you confirm that you are at least 18 years old, have the legal authority to enter into these Terms, and agree to comply with them in full. If you use our services on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of Services

Starbyte Studio LLC provides software-as-a-service (SaaS) tools, digital products, APIs, and related services (collectively, "Services"). Current offerings include ByteForge IDE, OrbitFlow, StarSheet, NovaDocs, StudioKit, and related products. We reserve the right to modify, suspend, or discontinue any Service at any time with reasonable notice.

3. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Keep your password secure and not share access with unauthorized parties.
  • Notify us immediately at admin@starbytestudio.com of any unauthorized use.
  • Accept responsibility for all activity occurring under your account.

4. Acceptable Use

You agree not to use our Services to:

  • Violate any applicable law, regulation, or third-party rights.
  • Transmit malicious code, viruses, or harmful content.
  • Attempt to gain unauthorized access to our systems or other accounts.
  • Reverse engineer, decompile, or disassemble any part of our software.
  • Resell or sublicense access to our Services without written permission.
  • Use automated means to scrape or extract data from our Services.
  • Generate or distribute spam, phishing content, or deceptive material.

5. Payment & Billing

Paid plans are billed in advance on a monthly or annual basis. All prices are in USD. By providing payment information, you authorize us to charge applicable fees. Subscriptions auto-renew unless cancelled before the renewal date. Price changes will be communicated at least 30 days in advance. Failed payments may result in service suspension after a grace period. For refund terms, see our Refund Policy.

6. Intellectual Property

All content, software, trademarks, and materials provided by Starbyte Studio LLC are our exclusive property or licensed to us. You retain ownership of any data or content you upload. By uploading content, you grant us a limited, non-exclusive, royalty-free license to host and process that content solely to provide the Services.

7. Privacy

Your use of our Services is subject to our Privacy Policy, incorporated into these Terms by reference.

8. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Services will be uninterrupted, error-free, or meet your specific requirements.

9. Limitation of Liability

To the maximum extent permitted by law, Starbyte Studio LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account if you violate these Terms or engage in fraudulent activity. You may terminate your account at any time by cancelling your subscription. Upon termination, your right to access the Services ceases.

11. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, USA. Disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association. You waive any right to participate in class-action proceedings.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email at least 14 days before taking effect. Continued use after changes constitutes acceptance.
